Terms of Service

These Terms govern your access to and use of the igamingsms.com website and the services provided by iGaming SMS ("we", "us"). By using the website or the services, you agree to these Terms. If you do not agree, please do not use the services.

1. What we provide

We provide message routing and delivery services for businesses:

  • A2P SMS, promotional and transactional, on neutral or branded sender identification
  • WhatsApp business messaging
  • Telegram campaign delivery
  • HTTP API and SMPP gateway access for server-side traffic
  • Campaign reporting and click analytics

These services are intended for iGaming operators, sportsbooks, affiliates and related businesses.

2. What we are not

We are a communications infrastructure provider. We are not a gambling operator and do not offer gambling in any form. We do not organise, promote or accept bets, and we hold no gambling licence.

You are solely responsible for obtaining every licence and authorisation your business requires, and for ensuring that your campaigns comply with the law of each jurisdiction you send to — including gambling, advertising, consumer protection and anti-spam legislation.

Nothing in these Terms constitutes legal advice. Information we publish about regulation in particular markets is provided for reference only and does not replace advice from your own counsel.

3. Eligibility

You must be at least 18 years old and act on behalf of a business. By using the services you confirm that your business operates lawfully in the markets it targets.

We may refuse or discontinue service where we suspect fraudulent, abusive or unlawful activity, or where continuing would place us in breach of a legal or contractual obligation.

4. Account and access

Access to the dashboard and to API credentials may require an account. You agree to provide accurate information and to keep credentials confidential. You are responsible for all activity carried out through your account and credentials.

Notify us without delay if you believe your credentials have been compromised.

5. Acceptable use

You agree not to use the services to send:

  • messages to recipients who have not given valid consent, or where no other lawful basis for contacting them exists;
  • content that is unlawful, fraudulent, deceptive or misleading;
  • content that infringes the rights of third parties;
  • phishing, malware, or links designed to deceive the recipient about their destination;
  • messages to recipients who have opted out of receiving them;
  • messages targeting minors, or promoting gambling in markets where such promotion is prohibited.

You are responsible for maintaining opt-out records and for honouring opt-out requests without delay.

Breach of this section may result in immediate suspension without prior notice.

6. Message content and sender identification

You are responsible for the content of every message sent through the services, for the accuracy of the sender identification you use, and for your right to use that sender identification.

We do not review message content before delivery. We may inspect content where necessary to investigate a suspected breach, to respond to a carrier complaint, or to comply with a legal obligation.

7. Contact data and data protection roles

For contact databases you upload or transmit to us, you are the data controller and we act as data processor. You are responsible for the lawfulness of the data, for obtaining valid consent from recipients, and for responding to requests from data subjects. We process such data only on your documented instructions and do not use it for our own purposes.

For data about visitors to our website and representatives of companies that contact us, we act as controller. Our Privacy Policy describes that processing.

8. Delivery

Messages are delivered through carriers and third-party messaging platforms. Delivery depends on factors outside our control, including carrier filtering, recipient device availability, number portability, and the policies of the messaging platforms.

We do not guarantee that any individual message will be delivered. We report the delivery status returned to us by the carrier or platform.

Where a test send is agreed before the start of a paid engagement, its scope and volume are agreed individually and do not constitute a commitment to any particular delivery rate.

9. Pricing and payment

Pricing is provided on request or by written quotation. Rates depend on the market, monthly volume, traffic type and delivery channel.

Payment terms are agreed in writing and may be prepaid or postpaid. Fees are non-refundable except where refund is required by law or expressly agreed.

Messages accepted by us and passed to a carrier are chargeable regardless of the delivery status subsequently returned, unless we agree otherwise in writing.

10. Service availability

We aim to keep the services continuously available and to schedule maintenance so as to minimise disruption, giving notice where practicable.

We do not warrant uninterrupted or error-free operation. Availability may be affected by carrier downtime, platform changes, network incidents and events beyond our reasonable control.

11. Suspension and termination

We may suspend or terminate access where you breach these Terms, where continued service would expose us to legal or regulatory risk, or where a carrier or messaging platform requires it.

Where circumstances allow, we give notice before suspension. Where a breach is serious or ongoing, suspension may be immediate.

You may terminate by written notice. Termination does not affect amounts already due.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, revenue, players, data or goodwill.

Our total liability arising from or in connection with the services is limited to the amount you paid us for the services in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Intellectual property

The website, its content, our trademarks and the materials we provide remain our property or that of our licensors. You may not copy, reproduce or redistribute them without our prior written consent.

You retain ownership of your content and your data. You grant us the limited right to process them as necessary to provide the services.

14. Changes to these Terms

We may update these Terms. The current version is published on this page with the date it took effect. Continued use of the services after a change takes effect constitutes acceptance.
